Let's assume you're importing a product that you mistakenly classify under an HS code that results in a more favorable (e.g., 18%) VAT rate. However, in reality, your product belongs to a different category that falls under a higher (e.g., 27%) VAT rate. Or even worse:
- VAT is the most common pitfall: For instance, consider a food product. If you incorrectly classify an item under Chapter 19 (e.g., baked goods or cereal preparations, which might be subject to 18% VAT), but an inspection reveals it actually belongs to Chapter 21 (e.g., 2106 – food preparations, typically subject to 27% VAT), you'll immediately face the difference that must be paid retrospectively, along with penalty interest. This can be a significant shock to your company's finances!
- Customs duties can also arise: Similarly, if you import a product that you incorrectly classify, and the correct HS code applies a higher duty rate (e.g., 5% or more instead of 0%), you will accumulate a customs duty shortfall in addition to the original duty and the difference.

What's the Best Practice? Protect Yourself from the HS Code Traps!
The key is precision and expertise. Don't underestimate the importance of the HS code!
- Know your product! Understand exactly what it's made of, how it's manufactured, and what its intended use is. HS code determination requires detailed product knowledge.
- Use the Combined Nomenclature (CN)! The CN is the basis of the EU's customs tariff system. It's a detailed table that helps with classification. (But it's not always enough on its own!)
- Request a Binding Tariff Information (BTI)!
- This is the most reliable way to determine the correct HS code! A BTI is an official, written decision issued by the Hungarian Tax and Customs Authority (NAV) regarding the classification of a specific product. This opinion is binding on you throughout the EU for a specified period. While processing can take time (up to 3 months), it provides long-term security. If you have a BTI, you won't be caught off guard!
- Seek expert opinion!
- If you don't have time for a BTI (e.g., due to urgent shipments), or just need a quick, reliable estimate (e.g., for quoting or a swift decision), turn to an experienced customs expert! They deal with these questions daily, are familiar with the latest regulations and practical applications. An expert opinion is not an official NAV ruling, but it's reliable guidance based on experience and deep knowledge.
